Official Contest Rules
A complete copy of these rules can be obtained at the offices of radio station KTCK (“Station”), owned and operated by Cumulus Media Inc. or one of its subsidiary companies, 3090 Olive Street #400 Dallas, TX 75287, during normal business hours Monday through Friday or by sending a self-addressed, stamped envelope to the above address.
The Station will conduct the Hard by the AAC Contest (the “Contest”) substantially as described in these rules, and by participating, each participant agrees as follows:
- No purchase is necessary. Void where prohibited. All federal, state, and local regulations apply.
2. Only legal U.S. residents age 18 or older with a valid Social Security number at the time of entry are eligible to participate in Station contests. Employees, agents, representatives, or affiliates of the Station, Cumulus Media Inc., its subsidiaries and affiliates, participating sponsors, other radio stations, television stations and print advertising companies serving the metro area, and their immediate family members and household members are not eligible to participate. The term “immediate family members” includes spouses, parents, siblings, grandparents, children, grandchildren and cohabiting significant others.
- An individual may win an on-going contest only once per six-month period unless otherwise specifically stated. An individual may win other seasonal or one-time contests only once for the duration of the contest. The Station reserves the right to limit the number of times an individual may enter a contest or drawing.
- The contest will begin on November 25, 2013 and will run through January 23, 2014 (the “Contest Period”).
- There is one way to enter this Contest:
- Visit the Station’s website at www.theticket.com and complete an online entry form. One entry per person, per household, per email address. All online entries must be received by midnight on January 23, 2014.
- On January 24, 2014, one (1) entrant will be randomly selected from all eligible entries as potential grand prize winner. If it is determined that the candidate is not eligible to receive the grand prize, in the Station’s sole judgment and discretion, another candidate will be randomly selected for eligibility consultation and this process will continue on until such time as an eligible candidate is found. In the unlikely event that no candidates are found to meet the specifications, then the prize will go un-awarded. In the event of a tie, the winner will be determined by and at the Station’s sole discretion.
- One (1) grand prize will be awarded. The grand prize package consists of the following: A 625 square foot one bedroom apartment home from Arpeggio located at 2425 Victory Ave Dallas TX 75219 for one year. Deposit fee, leasing fee and application fee will all be waived. Winners will be responsible for paying electric, water, trash, sewage and must carry renters insurance. Pet deposits, pet fees and monthly pet rent would be due if applicable. Winners must have approved credit and meet property qualifications, please see attachment. If winner is already renting at Arpeggio with Behringer Harvard Residential, they will receive up to a $1,200 rental concession per month not to exceed a 12 month period. Winner must take possession of the unit by 3/31/14 otherwise forfeits their winnings. Winner also allows property and station to use their likeness in marketing and media campaigns. All expenses and fees associated with the grand prize not expressly included in the foregoing prize description are the sole responsibility of the winner. Total grand prize package is valued at $14,400.
- Odds of winning depend on a number of factors including the number of eligible entries received and listeners participating at any given time.
- All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner. All those who win a prize or prizes valued $600 or more in any given year will be issued an IRS Form 1099 to report their winnings.
- All prizes are awarded “as is.” Prizes are nontransferable and cannot be exchanged. No substitute prize will be awarded to a winner who declines to accept a prize. The Station reserves the right to require contestants to be present at drawings in order to win their prize. The Station shall not be responsible for the failure of participating sponsors to deliver the prizes or any part thereof as described herein.
- All prizes must be claimed in person at the Station at the address identified above during regular business hours and within ten (10) business days of winning, excluding holidays, unless otherwise agreed to by the Station at its sole discretion. After such time, ownership of said prize reverts back to the Station to be disposed of at its discretion. The winner then loses all claims and rights to said prize. Proper identification must be presented by any winner to claim prize. As a condition to receiving any prize, each potential winner must complete and sign a Winner’s Affidavit and Release, releasing the Station from all liability in connection with winner’s participation in the contest and acceptance, use, or non-use of the contest prize.
- All entrants and winners agree that the Station shall have no liability for any injury, misfortune, or damage to either persons or property incurred by entering, participating in, winning, or losing any contest and/or by the acceptance, use, or non-use of any prize received in connection with this contest.
- All entry blanks, forms, devices, and materials gathered during the course of entry, as well as all information contained on or within, shall become the sole property of the Station to be used, disposed of or destroyed in its sole discretion. The Station is not responsible for any incorrect or inaccurate information entered by website users, and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the Station’s website.
- By participating in a Station contest in which text-message-based entry is permitted, entrants acknowledge that text messages are distributed and delivered through third party providers. Station does not guarantee, nor shall Station be in any way responsible for, the delivery or timeliness of any text message entry. Station will at all times consider the time that a message is logged as arriving in its system as being the time of entry, regardless of the time at which the entrant attempted to send the entry and any technical problems or other complications that may have delayed its delivery. Station is not responsible for service outages, message failures, transmission delays or any other factor affecting the availability or performance of the text messaging service. Contests with text-message-based entries are subject to the Station’s Privacy Policy. By participating in Station contests, entrants agree that the Station may contact that entrant at the telephone number from which the text message entry was received. All text message entries must come from a valid and identifiable telephone number. Station reserves the right, in its sole discretion, to disqualify any entry if that entry’s source and sender cannot be reasonably determined. Station, through its third party text messaging administrators, will store all messages received on its system. Station may require, on request, proof of identity as to the rightful owner of the phone number from which the text message entry was sent.
- All entrants and winners agree to give the Station and its licensees, affiliates, successors, and assigns the irrevocable and unrestricted right to use, re-use, broadcast, or publish their name, city of residence, photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched or distorted in character or form, and winner’s voice, recorded or live, for any reason the Station deems necessary without compensation, unless prohibited by law. All winners release, discharge, and agree to hold the Station harmless from any and all claims they may have against the Station in connection with the taking, production, or the use of winners’ name, city of residence, any photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched, or distorted in character or form and without restrictions as to any changes, transformations or alterations, and including winners’ voices, recorded or live. All winners further acknowledge that the Station owns or will own exclusively any photographs of such winners used for such purposes, including the copyrights in them, regardless of the form in which they have been or may be produced and used, and all winners assign all such ownership rights to the Station.
- By participating in the Contest, each participant agrees to receive email communications from the Station regarding Station events and contests. Any participant that opts-out of these mailings will also remove themselves from the contest. By participating in the Contest, where allowed by law, participants agree that the Station may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes.
- By participating in the Contest, participants agree to be bound by the decisions of Station personnel. Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Station will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Station’s decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Station, the Station reserves the right to terminate this Contest, or make such other decisions regarding the administration or outcome as the Station deems appropriate. All decisions will be made by the Station are final. The Station may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, STATION RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
- By participating in this contest, each participant agrees to waive any and all claims for damages for death, personal injury, loss of property or property damage that he or she may sustain as a result of his or her participation in the contest and/or the use of any prize, and any damages or losses arising from the implementation or carrying out of the contest or any participant’s failure to win the contest or receive the prize, and to release the Station, Cumulus Media Inc. and its subsidiaries, affiliates, directors, officers, employees, agents, and all contest sponsors from any and all liability arising out of or connected in any way with his or her participation in the contest, even though that liability may arise out of an intentional act, omission, negligence or carelessness on the part of the persons or entities mentioned above.

FAIR HOUSING STATEMENT
Behringer Harvard Residential is committed to compliance with all federal, state and local fair housing laws. It is our policy to offer apartments for rental to the general public without regard to race, color, national origin, religion, sex, familial status, or handicap. The employees of Behringer Harvard Residential have a legal obligation to treat each individual in a consistent and equally fair manner. In order to assist you with your decision on your new home, we are providing a list of guidelines used to qualify residents for tenancy in our community. Please note that this is our current rental criteria; nothing contained in these requirements shall constitute a guarantee or representation by Arpeggio at Victory Park that all residents and occupants currently residing at Arpeggio at Victory Park have met these requirements. There may be residents and occupants that have resided at Arpeggio at Victory Park prior to these requirements going into effect. Additionally, our ability to verify whether these requirements have been met is limited to the information we receive from various resident credit reporting services used.
Please review this information before filling out an application and paying the following:

INCOME/EMPLOYMENT
All persons applying for an apartment must have a local verifiable source of income in a gross amount no less than three (3) times the rental rate. The rental amount for this apartment is $__________________________, therefore, your gross monthly income amount must be no less than $___________________________ to qualify without a guarantor. All check stubs must show year to date earnings. If not available, the prior year’s income tax return will be required. You must be employed with your current company/position or previous company/position for a minimum of six (6) months.
RENTAL HISTORY
Six (6) months of past rental history must be satisfactory (i.e., rent paid on time, lease obligation fulfilled, residence left in satisfactory condition with no outstanding charges for damages). An eviction would constitute cause for denial. Less than six (6) months rental history may require an additional deposit if unable to obtain a guarantor.
CREDIT
Applicant(s) must have a credit rating in “Good Standing” for the past 24 months. No unpaid bills, liens, bad debts, judgments or bankruptcies within the last two (2) years. Lack of established credit, or a negative credit rating of 50% or more will require either a double deposit, or a guarantor will be required. No debt to other rental communities is permitted at anytime.
GUARANTOR
A guarantor will be accepted for lack of rental history, lack of credit, or insufficient income. Guarantors will not be accepted as a substitute for negative rental history. Guarantors are required to have a verifiable source of income in a gross amount no less than four (4) times the market rental rate. The rental amount for this apartment is $_________________, therefore, the guarantor’s gross monthly income amount must be no less than $_________________. Guarantors must have consecutive employment for one (1) year and possess positive credit and rental/mortgage history. Guarantors will be held fully responsible for the lease.
SMOKE FREE POLICY The Arpeggio at Victory Park and all areas of The Arpeggio at Victory Park is a smoke free environment. Smoking is strictly prohibited. The term “smoking” means to inhaling, exhaling, burning, or carrying any lighted cigar, cigarette, or other tobacco product or similar lighted product in any manner or in any form. Resident acknowledges and agrees Resident and all of Resident’s occupants and guests shall not smoke anywhere in the building in its entirety, including, but not limited to, restrooms, stairwells, entrances, exits, elevators, roof, common areas, patios and corridors. Residents will take reasonable steps to enforce the No Smoking Policy against employees, business invitees, customers, and other guests. It is the Resident’s responsibility to inform his or her guest of the prohibition of smoking.
OCCUPANCY
The maximum numbers of residents permitted to dwell in an apartment shall not exceed two (2) occupants per bedroom. The only exception to occupant limitations is anyone protected as familial status under Federal Fair Housing Guidelines. In this case, we will allow 2 persons per bedroom, plus one additional person in the apartment home, according to the size of the floor plan. For the purposes of this occupancy policy a “family” shall consist of the following persons: One or more individuals (who have not attained the age of 18 years) being domiciled with: (1) a parent or another person having legal custody of such individual or individuals; or (2) the designee of such parent or other person having such custody, with the written permission of such parent or other person. The term “family” shall also apply to any person who is pregnant or is in the process of securing legal custody of any individual who has not attained the age of 18 years.
A current Driver’s License or State ID is required for all persons age 16 years and older. If you have indicated that you are a Non-US Citizen, you will submit a supplemental application for Non-US Citizens.
BACKGROUND SCREENING
All applicants and adult occupants age 16 and older must submit to background screening. If any applicant or adult occupant has a conviction or has received deferred adjudication for any felony or has a conviction or has received deferred adjudication for the following class A misdemeanor offenses, the Applicant and/or Adult Occupant will be rejected:
1 Offenses classified by the State Penal Code, as felonies or misdemeanors such as an offense against the person, an offense against the family, arson, property damage or destruction, robbery, burglary and criminal trespass, theft, weapons and DWI felonies.
2 Offenses identified in the State Controlled Substances Act as a class A misdemeanor.
3 Any other offenses involving any misdemeanor offense for which a person is required to register as a sex offender in the state.
4 Any federal offenses or offenses in another jurisdiction classified in a category similar to those identified in this section.
